Terms and Conditions

The terms and conditions constitute legal agreement between you and A.STYLE (“A.STYLE”, “we”, “our” or “us”). By accessing and use of the website at art.astyle.com.hk (this “Site” or the “Site”), you expressly agree and bound by the terms of use and service.

A.STYLE reserves the right to change these terms at any time, and it is your responsibility to check at regular intervals for any changes.

1. Registration

1.1.  To use some of the services or features on the Site, you will need to register. When you register you are required to provide personal information including your legal name, phone number, email address and other data as indicated. In all cases, you are required to provide information that is true, accurate, current, and complete in all respects.

1.2.  The account username and password will send to you after the registration is completed. You are responsible for keeping your password secure. Should any of your registration information change, or unauthorized use of your account please notify us immediately by e-mail at art@astyle.com.hk. We may also change registration requirements from time to time.

2. Pricing

2.1.  Prices shown on the Site are in Hong Kong dollars (HKD).

2.2.  All prices are exclusive of VAT and other government duties. Applies to deliveries outside Hong Kong, you may be subject to pay additional import taxes and customs levied by the destination country.

2.3.  If your credit or debit card is not denominated in Hong Kong dollar (HKD), the finial price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day of your card processes the transaction.

2.4.  Price is subject to change without prior notice.

3. Order

3.1.  Order Acceptance

3.1.1. All orders are subject to acceptance and availability by A.STYLE.

3.1.2. Acceptance of your order and completion of the contract between you and A.STYLE will be completed when we send a confirmation email to you to confirm that the Product has been dispatched.

3.1.3. A.STYLE reserve the right not to accept an order for reasons as written below:

      • The product that you ordered is out of stock or is withdrawn from sale for any reason.
      • We are unable to obtain authorization for payment.
      • Pricing or product description error occurred.
      • Shipping restrictions apply to one or all of the ordered items.

3.2.  Order Cancellation

3.2.1. No refund or exchange for special order items after order confirmation.

3.2.2. Order cancellations only apply before the commencement of manufacture of your ordered product.

3.2.2.1.  A confirmation email must be sent to art@astyle.com.hk within 24 hours from the moment your order has been placed, we will refund to your relevant credit or debit account any amount charged by us within 30 days following the receipt of your cancellation email.

3.2.3. We reserve the right to cancel and refund any order, at any time.

 4. Promotional code

4.1. Promotion codes are only valid for orders placed online.

4.2. Promotional code may only be used in the period of time specified in A.STYLE’s email or print material. The codes are no longer valid after the expiry date of the offer period.

4.3. The placing of an order is subject to availability and A.STYLE reserves the right to amend, withdraw or terminate the validity of any Promotional Code at any time.

 5. Payment

5.1. We accept payment by Cash, Union Pay, Visa, MasterCard and American Express for in store purchase.  

5.2. Online payment completed by PayPal.

5.3.  For special order items in store, when customer chooses to pay by cheque or bank transfer, we will proceed the ordering of the product once we received the deposit. All online orders must be completed in full to proceed the ordering. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products will be correct; that the credit charge that you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge details before accepting your order.

5.3.1. Payment will be taken in 50% deposit or in full at the time of the order, when the products arrived to our shop, customer should pay the remaining amount. After we received the remaining payment, the products will then be delivered to or be picked up by the customer.

5.3.2. The copy of deposit slip or bank advice must send to art@astyle.com.hk within three working days from the day of order confirmation.

 6. Delivery

6.1. Delivery charge is excluding onsite installation.

6.2. We are not able to offer our delivery service to restricted areas, P.O. Box or locked bag addresses.

6.3. Delivery to areas in Hong Kong is free of charge if the order is HKD$10,000 or above. For order less than HKD$10,000 or outside Hong Kong, delivery charge will be applied.

6.4. You are liable for payment of all delivery charges, including any additional charges incurred as a result of difficulties with access. For the areas that cannot be reached directly by vehicles, buildings without a functioning lift or if the items do not fit into your lift that you will be responsible for paying the walk-up charge.

6.4.1. You must ensure correct delivery address details are provided to us and notify us in advance if there will be difficulties accessing the delivery address (for example staircases or narrow passages).  You are responsible for ensuring there is adequate access and entry to the site to allow the delivery of the products.

6.5. Our delivery service does not apply to breakables, plants & display items sold, and to addresses where goods cannot be delivered via stairs but have to go through the balcony on arrival, flats on the 9th floor or above in buildings without elevators or floating homes (boathouse or yacht) or construction / renovation site.

6.6. Should deliveries be made to a quayside or pier on Hong Kong Island or in Kowloon, the customer shall be responsible for arranging sea transport and loading/unloading, and paying for any charges thus incurred. Additional purchases, new sales memos & amendments must be made three days before the scheduled delivery date.

6.7. The deliveries will be suspended under bad weather conditions, such as rain with thunderstorm, when typhoon signal No.8 is hoisted, a black rainstorm warning is in effect or when ships are suspended, serious flooding occurs or roads are blocked or closed due to weather factor. Delivery appointment will be re-arranged at no additional charge.

6.8. Products will only be delivered if a person is aged over 18 years and able to accept delivery is at the delivery address. Should an appropriate person not be available to accept delivery on the pre-arranged delivery date, you will be charged for transport and re-delivery costs.

 7. Return Policy

7.1. We do not have a refund policy, but if the product does not correspond with how it was presented then you may return the item to us for an exchange. We will first try to see if it is possible to remedy the fault, otherwise we are happy to replace the product.

7.2. We will accept an item for an exchange if the item is returned to us within 7 days of your receipt and it is in a “Saleable Condition”. It means the product is with it’s original packaging with the tag or label on, unused, unwashed, and in the same condition originally sold. Please ensure the returned item is securely repackaged. We strongly recommend you use an insured registered mail service as return not received by us cannot be exchanged.

7.3. When we have received the product and approved the claim you will be informed and a new product along with compensation return-shipping costs will be sent to you.

7.4. Returns received in customer damaged/ worn condition and any items marked as final sale are non-refundable and non-exchangeable.

7.5. We will replace or exchange the same product for you at your request if you received a defective product that is damaged at the time of delivery.

7.6. No return or exchange will be accepted for large items, bespoke or customized products shipped internationally. The only exception permitted in the case if the item is a defective product.

 8. Warranty

8.1. We warrant our large furniture to be free from defects in materials and workmanship under normal use for a period of one year from the date of delivery or pick-up.

8.2. The warranty is limited to the original purchaser with a receipt.

8.3. Warranty service will be provided through in-home service at a normal trip charge.

8.4. The trip charge will be waived for merchandise delivered by us if a warranty defect occurs and is reported within the thirty days of receipt. Visible surface damages (scratches, nicks, tears, etc.) are not covered under this warranty unless reported within the first seven days of delivery.

8.5. We are not responsible for visible surface damage to product that has been picked up from our shop unless it is noted at the original time of pick up.

8.6. The warranty is VOID if the merchandise has been moved from the original delivery address or if we determine the furniture damage was caused by abuse, negligence, accident, or if used for purposes other than those intended, such as commercial use.

8.7. The above stated warranty is limited to repair or replacement of defective product. Any damage for breach of warranty due to consequential losses to property other than the defective product is excluded. 

9. Intellectual property rights

9.1. Unless otherwise indicated, A.STYLE owns the Intellectual Property on the Site, the “Content” including copyright, data, text, graphics, software, program, HTML and other code contained in this Site. Any and all Intellectual Property, contained, mentioned or displayed on this Site are protected by copyright, design, trademark, intellectual property and other laws and international treaty provisions.

9.2. Your use of this Site and its Content grants no rights to you in relation to any Intellectual Property and material rights relating to the Content. You are authorized to use the Intellectual Property only as expressly authorized by us and/or its third party licensors strictly in accordance with the terms and conditions as set out herein.

9.3. This Site is for your personal and non-commercial use only. Any modification, reproduction or redistribution, transmission, display, publication, sale or license of the Intellectual Property available on this Site or creation of derivative works from the Intellectual Property for any purpose is not authorized and may result in civil and criminal penalties. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution or any other purposes not expressly authorized hereunder is expressly not authorized. However, you are authorized to make one copy for the purposes of viewing Content for your own personal use.

 10. Content from third party

This Site may contain hyperlinks and other websites operated by third parties. These linked websites are not under the control of A.STYLE, and we are not responsible for the contents of any linked website or any hyperlink contained in a linked website. A.STYLE will not accept responsibility for them or be liable for any loss or damage caused by or in connection with your use of these websites.

 11. Disclaimer & Limitation of liability

11.1.  All content on the Site is provided “as is” and without warrant or guarantee to the following:

  • The availability, accuracy and completeness of any information published on the Site.
  • The use of the Site will be uninterrupted, technical inaccuracies or error free.
  • The content and servers that is free from viruses or other contamination.

11.2.  We accept no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect), however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of our Web Site or its contents, we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause whether on the part of us or our servants, agents or other person.

12. Indemnity

You agree defend, indemnify and hold us, our officers, directors, employees, agents, affiliates, licensors and suppliers, harmless from and against all liabilities, claims, expenses, costs, damages and losses, including legal fees, arising from or related to your negligence or any breach of the Terms and Conditions by you including the use by any other persons accessing this Site using your Internet account as a result of or in relation to your action or inaction.

13. Your action

We may take action against you if you engaged in the following unauthorized and prohibited activities:

  • Submitting material (including, but not limited to text, images, music or video) of which you have no rights to grant
  • Initiating communications that contain any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, or racially, ethnically or otherwise objectionable material
  • Advertising or sending unsolicited messages of any kind.
  • Impersonating others or providing any kind of false information
  • Starting or forwarding chain letters of any kind

 A.STYLE reserves the right to terminate any account at its sole discretion.  We may send you an email to inform you of the termination of your account in such event.

14. Governing Law

The Terms and Conditions together with all our policies and procedures are governed by and constructed in accordance with the law of Hong Kong Special Administrative Region.
